Intellectual Property refers to several types
of legal (government granted) monopolies. Intellectual monopoly priveledges (IMP) include copyrights, trademarks and patents.

U.S Copyright laws have little in the way of punishment for those who abuse IP law. The US Copyright Act, section 512(f) punishes for using the safe harbor provisions of the Digital Millenium Copyright Act to remove material the issuer knows is not infringing.

However in this case the e-bay seller above is located in the UK. While US IP laws lack punishments, several other countries IP laws do provide punishment for those that make false claims or groundless threats of legal proceedings. He might want to check into filling a complaint with the British equivalent to the Patent & Trademarks Office.
Remember boys and girls if you can buy used or overstocked parts you don't have to purchase brand new.

Antitrust Laws and You

Many consumers have never heard of antitrust laws, but when these laws are effectively and responsibly enforced, they can save consumers millions and even billions of dollars a year in illegal overcharges. Most states have antitrust laws, and so does the federal government. Essentially, these laws prohibit business practices that unreasonably deprive consumers of the benefits of competition, resulting in higher prices for inferior products and services.

There are three major federal antitrust laws: the Sherman Antitrust Act, the Clayton Act, and the Federal Trade Commission Act. The following information on these laws comes from the Antitrust Enforcement and the Consumer guide.

Sherman Antitrust Act
This Act expresses our national commitment to a free market economy in which competition free from private and governmental restraints leads to the best results for consumers. This Act outlaws all contracts, combinations, and conspiracies that unreasonably restrain interstate and foreign trade. This includes agreements among competitors to fix prices, rig bids, and allocate customers, which usually are punishable as criminal felonies.

The Sherman Act also makes it a crime to monopolize any part of interstate commerce. An unlawful monopoly exists when only one firm controls the market for a product or service, and it has obtained that market power, not because its product or service is superior to others, but by suppressing competition with anticompetitive conduct.

The Act, however, is not violated simply when one firm's vigorous competition and lower prices take sales from its less efficient competitors; in that case, competition is working properly.

The Clayton Act
This Act is a civil statute (carrying no criminal penalties) that prohibits mergers or acquisitions that are likely to lessen competition. Under this Act, the government challenges those mergers that careful economic analysis shows are likely to increase prices to consumers. All persons considering a merger or acquisition above a certain size must notify both the Antitrust Division and the Federal Trade Commission. The Act also prohibits other business practices that may harm competition under certain circ**stances.

The Federal Trade Commission Act
This Act prohibits unfair methods of competition in interstate commerce, but carries no criminal penalties. It also created the Federal Trade Commission to police violations of the Act.

The Department of Justice also often uses other laws to fight illegal activities, including laws that prohibit false statements to federal agencies, perjury, obstruction of justice, conspiracies to defraud the United States and mail and wire fraud. Each of these crimes carries its own fine and imprisonment term, which may be added to the fines and imprisonment terms for antitrust law violations.

In economics, a monopoly (from Greek monos , alone or single + polein , to sell) exists when a specific individual or enterprise has sufficient control over a particular product or service to determine significantly the terms on which other individuals shall have access to it.[1] Monopolies are thus characterized by a lack of economic competition for the good or service that they provide and a lack of viable substitute goods.[2] The verb "monopolize" refers to the process by which a firm gains persistently greater market share than what is expected under perfect competition.

A monopoly should be distinguished from monopsony, in which there is only one buyer of a product or service ; a monopoly may also have monopsony control of a sector of a market. Likewise, a monopoly should be distinguished from a cartel (a form of oligopoly), in which several providers act together to coordinate services, prices or sale of goods. Monopolies can form naturally or through vertical or horizontal mergers. A monopoly is said to be coercive when the monopoly firm actively prohibits competitors from entering the field.

In many jurisdictions (particularly in the United States and South Korea), competition laws place specific restrictions on monopolies. Holding a dominant position or a monopoly in the market is not illegal in itself, however certain categories of behavior can, when a business is dominant, be considered abusive and therefore be met with legal sanctions. A government-granted monopoly or legal monopoly, by contrast, is sanctioned by the state, often to provide an incentive to invest in a risky venture or enrich a domestic constituency. The government may also reserve the venture for itself, thus forming a government monopoly.
I have been informed and believe the following information to be true and correct:

"Current U.S. IP law carries severe criminal and civil penalties for copyright violations. Current U.S. IP law seem to provide few disincentives against those who through impropriety and/or overbroad claims of right, falsely claim the benefits of U.S. IP laws.

Unfortunately, very few victims of spurious IP claims have the financial means to bring suit on their own behalf. Federal law does not provide an adequate class action mechanism to address spurious IP claims in the context of consumer deception. Consumers do not have standing under either the Lanham Act or the Federal Trade Commission Act to bring suits for false representations and deceptions.

However, cause of actions based on consumer protection statutues have been used successfully against those who making spurious IP claims and threats. Cause of actions based on spurious claims of protection under IP law would seem to be particularly amenable to class treatment. Not only is the burden of proof low, but the opportunity for enhanced damages and attorneys' fees would help to address any deterrence issues. Furthermore, state law can provide the necessary class action vehicle to consumers. Some states expressly authorize consumer class actions for violations of deceptive trade practices acts or little FTC statutues."
